Occupational Health and Safety Act (OHSA) s.43 refusal steps for stewards and joint health and safety committee (JHSC) members. Not legal advice.
Not legal advice
This is an overview of the procedure only. Confirm it against your JHSC’s practice, with your local officers, and in the current OHSA text.

Use Module 10 when you want to practise the next step with a scenario and a checklist you can bring to a meeting.
Joint Workplace CommitteesThe wrong path costs time
Routing a CA dispute through a refusal, or treating a live refusal as “just a JHSC item,” damages trust and can leave the member without pay or protection. Fix the path first.
Takeaway
If the member has not reported to a supervisor yet, your first job is getting the report on the record — not debating whether the hazard is real.
Do not delay the call
If stage 1 ended with “just do the task” and the member still believes they are in danger, stage 2 is not optional politeness — it is the statutory escalation path.
Treat reprisal as live safety
A member who refused and then gets disciplined needs the same urgency as the original hazard. Document today; escalate today.
The member reports dizziness and fumes to the supervisor at 09:15. The steward arrives by 09:30. The member stays in the hallway, available but not on the task.
The supervisor, a JHSC worker member, and the steward meet at 10:00. The employer offers a different rag and an open door. The member says the danger persists without ventilation and a review of the SDS for compatibility. Notes are taken, and the SDS is photographed.
The member still refuses at 11:00. The JHSC worker member notifies the ministry. The inspector arrives in the afternoon, interviews the member and the supervisor, and orders a ventilation check before work resumes.
At 14:00 a temporary worker is sent to finish the room without being told of the refusal. The steward documents this, informs the temporary worker, and adds a note to the inspector file.
The member is paid for the shift. The local posts a pocket-card QR code with the s.43 steps and JHSC contacts. Watch for reprisal over the following weeks, and check that no discipline entries are tied to the refusal date.
Takeaway
If your timeline skips the written report or stage 1 attendance list, rebuild it before the inspector interview.
