The Bargaining Lifecycle: From Survey to Signing

How Local Bargaining Committees manage membership from demand setting through ratification

Negotiating a Collective Bargaining Agreement (CBA) is the most important thing your local will do. Even if your National or Provincial union sends a Staff Representative to lead the negotiations, the Local Bargaining Committee must manage the membership. Here is the standard lifecycle of contract negotiations in Canada/Ontario.

Phase 1: Preparation & The Demand Setting

Months before the contract expires, the committee listens to members and opens negotiations formally.

The Member Survey. Months before the contract expires, you must survey your members. What are their priorities? (Wages, sick days, scheduling, safety?)
Demand Setting. The committee reviews the surveys and drafts the initial proposals to present to the employer.
Notice to Bargain. A formal legal letter sent to the employer (usually 90 days before expiration) officially opening negotiations.

Phase 2: The Table

Both sides meet, exchange proposals, and keep members engaged without breaking table discipline.

Exchanging Proposals. Both sides meet and exchange their lists of demands.
The Blackout. Usually, what happens at the table stays at the table until a tentative agreement is reached. However, the committee must still send out Bargaining Updates to keep the membership mobilized and engaged.

Phase 3: Dispute Resolution & The Strike Vote

If negotiations stall, the legal clock starts.

Conciliation. A government-appointed neutral third party tries to help both sides reach an agreement.
The Strike Vote. To give the bargaining team leverage, the local holds a vote asking members to authorize a strike if a fair deal isn't reached. A strong Yes vote often forces the employer to concede.
The "No Board" Report (Ontario). If conciliation fails, a No Board report is issued. This starts a countdown (typically 17 days in Ontario) before a legal strike or lockout can occur.

Phase 4: Ratification and Signing

A deal only becomes the new agreement when members vote and both parties sign.

Tentative Agreement (TA). The bargaining team reaches a deal with the employer.
Ratification Vote. The TA is brought back to the general membership. They vote by secret ballot to accept (ratify) or reject the deal.
Signing. Once ratified, the new Collective Agreement is officially signed by both parties and printed.
